Age Discrimination


Under Sections 4(h) and Section 5 of the Pennsylvania Human Relations Act (PHRAct) and under the federal Age Discrimination in Employment Act (ADEA), persons 40 years of age or older are protected from discrimination in employment. The PHRAct prohibits age discrimination in hiring, discharge, promotions, fringe benefits and other aspects of employment. Retaliation against a person who files a charge of age discrimination, participates in an investigation or opposes an unlawful practice is also unlawful. The PHRAct applies to employers of 4 or more employees. Employees include both full and part time employees.
