State agency employees must have access to their personnel records that relate to employment history and other state agency personal record information. The employee may not have access to:
1) Any information relating to criminal investigations;
2) Any information that identifies a source of information under confidentiality;
3) Any test scores and exam material which would affect the effectiveness of the test or the examination process;
4) Any information relating to an investigation concerning current or pending actions against the employee;
5) Any other information which is required to be withheld by law.
Every agency that maintains accessible personnel records, must make the records available to the individual it pertains to, in a reasonable and prompt manner as well as in a reasonably intelligible form. As is necessary, the agency must provide a translation, into common terms, any machine readable copies or of any code or abbreviation used for internal agency use.
