If an employer discharges an employee, the wages earned and unpaid at the time of discharge are due and payable immediately.
Upon termination of employment, all earned and unused vacation must be paid to the employee, unless stipulated otherwise in a collective bargaining agreement. Vacation pay accrues as it is earned and cannot be forfeited. Employers may not have a use it or lose it vacation policy. Employers are allowed to place a cap on the amount accrued.
